After Brexit, British EORI is no longer applicable to the EU, resulting in a large number of Chinese sellers in the European market needing to register EORI in Germany for bilateral customs clearance. Ambo also began to arrange for sellers in advance in August 2020. The approval was slow at the beginning, but part of EORI numbers could still be taken down. Later, the German customs had a backlog of APPLICATIONS for EORI number, and the approval was delayed. This also causes the service providers and sellers of the industry are highly concerned about "When the German EORI can come down"?

Just yesterday, our AMBER German office received the official notice of customs deployment, confirming that the offshore company could not apply for the German EORI.

Check out the official reply from German customs:
"Various EORI applications submitted for your company's clients from November 2020 to present". The General Administration of Customs rejected our application, "he said, saying Chinese sellers do not need EORI numbers as third-country operators.
❌ Reasons for Refusal
1、It is because the German Customs authorities, under Article 9(1) or (2) of Regulation 952/2013(CCC), combined with Article 5(6) of the (EU)2015/2446(CCC-DA) Delegated Regulation, For economic operators outside the union customs territory, there is no need to register the EORI number.
2、Third country traders, Not on a regular basis Appearing as a declarator on an import declaration form cannot regularly appear as an exporter/declarator on an EXPORT declaration form at EU customs. According to article 170(3) of the International Criminal Code, a third country business does not need a German customs number. Without customs number, you can clear customs 9 times a year.If the enterprise has a permanent operation in Germany, it can apply for a customs number from the German customs.

Contents of the official notification by the General Administration of Customs
Obviously, the Chinese seller, as a (third country) trader not established in the EU customs area, has no permanent establishment in Germany, and the German customs will not accept registration and issue EORI number. There is still no clear information as to whether the German EORI which has been obtained by the Chinese seller before this notice will be invalid.
