Which sellers require EU representation?

1. Sellers who sell products within the EU.

2. Sellers whose products fall within the scope of UKCA certification.

3. Sellers whose product manufacturers are located outside the EU.

Which products require CE/UKCA marking?

Most products sold in domestic e-commerce markets that are exported to the European Union require CE/UKCA marking. These products include toys and games, televisions/audio equipment, personal protective equipment, machinery, building products, gas equipment, leisure and private watercraft, pressure vessels, and measuring devices, among others.

Note that products with or without electrical components require CE/UKCA marking. Even if the product packaging does not display the CE/UKCA mark, if the product is subject to relevant certifications, it will be required to provide CE/UKCA marking.

Requirements for EU Authorized Representatives

EU Authorized Representatives may represent manufacturers outside the EU in dealing with customs and government agencies in European countries.

The name and address of the manufacturer's EU Authorized Representative must be clearly printed on the packaging, labeling, and instructions for use of products imported from outside the EU bearing the CE mark.

The EU Authorized Representative must maintain up-to-date 'technical files' for all CE-marked products and ensure that they can be made available to EU-based CE supervisory authorities at any time. EU law requires that these technical files be kept at the EU Authorized Representative's premises for at least 5 years after the last batch of products is placed on the market.

Manufacturers outside the EU must establish an effective 'accident prevention and monitoring system' in the EU and provide assistance to their EU Authorized Representative in reporting accidents, notices, recalls, and other product-related matters.

EU Authorized Representatives may also act on behalf of manufacturers in handling product registration and application matters.
